DATE : November 07, 2017 By this application it is prayed that the amounts deposited by the petitioner be permitted to be withdrawn by the respondent. Order dated 09/04/2013 records that an amount of Rs.12 lacs was being deposited by the petitioner voluntarily. This application was filed on 24/04/2013. It was taken up for consideration and on 30/09/2013 the Court observed that this deposit was made subject to the rights of the petitioner that were to be decided in the writ petition.

The prayer as made was not granted and instead the writ petition was directed to be finally heard. Considering the observations made in that order it is clear that the Court was not inclined to grant the prayer made in the application. Hence this application stands disposed of in terms of order dated 30/09/2013.

Liberty to apply for grant of early hearing.
