Heard Shri R.R. Rajkarne, learned Counsel for the applicant/appellant, Shri S.S. Doifode, learned A.P.P. for respondent no.1 and Shri R.R. Vyas, learned Counsel assisting prosecution.

Submission of learned counsel for the applicant is, that the appellant/accused no.6 is not alleged to have participated in the actual crime. He was standing outside the bar. Shri Rajkarne, learned counsel submits that the accused no.2 came out running with some weapon and sat on his motor cycle.

According to the learned A.P.P., accused no.6 has assisted other accused persons in running away, after crime was committed. Learned A.P.P. also invites attention to evidence of P.W.6 to demonstrate that he saw the present applicant coming out of 7 Hill Bar on two wheeler.

After appreciating the evidence of P.W.6 and other evidence, we have today rejected bail application of accused/Amol Mandade.

In this situation, we find no substance in the present application. The same is rejected. No costs.
