After hearing at some length we have expressed our non-inclination to accede to the prayer of quashing of chargesheet.

At this stage, learned Counsel for the applicant seeks for withdrawal with liberty to apply to the trial Court for discharge or any other relief since admittedly yet sanction has not been granted to prosecute for the offence punishable under Section 505(1)(b) of the Indian Penal Code.

During the course of hearing learned A.P.P. has tendered on record communication showing that Police Commissioner has applied for sanction. Same be kept on record.

Criminal application stands disposed of since withdrawn as prayed for.
