Heard Mr. Bhatt, learned counsel for the applicant. This is an application for condonation of delay in preferring the appeal. The delay is of 110 days.

Notices on this application were issued to the non applicants. All the non applicants are duly served. The claimants are represented by Mr. A. R. Kaple, Advocate holding for Mr. A. M. Quazi, learned counsel for the claimants. Though, non applicant no.4-driver of the offending vehicle is served, nobody is appearing.

Though, the application is vehemently opposed by the learned counsel for the claimants, for the reasons stated in the application and after hearing learned counsel for the applicant, I am satisfied that the applicant has made out a case for condonation of delay. Consequently, the application is allowed. Delay caused in preferring the appeal is condoned. Office is directed to register the appeal.

The application is disposed of.
