After arguing for sometime Shri. Shyam Dewani learned advocate for the applicant seeks permission to withdraw the application, however, requests for directions to the Special Court to conclude the trial within 6 months. It is further requested that if trial does not make any progress for 3 months, the applicant may be granted liberty to reiterate his request.
The application is dismissed as withdrawn.
Looking to the fact that the prosecution has to examine large number of witnesses, in my view, it would not be proper to give direction to the Special Court to dispose of the trial within stipulated time. The applicant is granted liberty to request the Special Court for expeditious trial. It need not be said that the request of the applicant for expeditious trial would be considered appropriately by the Special Court keeping in mind the fact that the applicant is in jail more than 3 years.
