This is an application filed by the Applicants - Respondent Nos.1 and 2 for withdrawal of the amount deposited by the Appellant in Commissioner Court/First Labour Court, Nagpur.

Heard learned Counsel for both the parties.

Having considered the grounds of Appeal and impugned Judgment and Award passed by the learned Labour Court, Nagpur, I am of the view that the amount deposited in this Court is allowed to be withdrawn conditionally.

Hence 50% of the amount of Rs.7,56,225/- along with interest at the rate of 12% per annum deposited in the First Labour Court is allowed to be withdrawn and remaining 50% of the amount deposited be kept in Fixed Deposit of Nationalized Bank till the decision of this Appeal.

25% of the amount on usual undertaking and 25% of the amount on solvent surety both to the satisfaction of the learned Registrar (Judicial) of this this Court to be furnished within four weeks from the date of order.

Civil Application stands disposed of in above terms.
