Shri N.B. Rathod, learned Counsel seeks leave to withdraw the application unconditionally.

The application is permitted to be withdrawn unconditionally.

However, it is disturbing to note that although the accused are in custody since three and half years, even the charge is not framed. The Registrar (Judicial) of this Court is requested to call for a report from the trial Court as to why the charge is not framed.

The trial Court is directed to frame charge and conclude the trial within nine months from today. 6.

If there is no significant progress or development

2 ba325.18 in the trial in the next three months, the applicant shall be at liberty to apply for bail afresh.

The Registrar (Judicial) to bring this order to the notice of the trial Court.

8.

The trial Court to submit the report within a week.
