The petitioners who are the defendant nos.2 to 4 in the suit filed by the respondent no.1 herein are aggrieved by the order passed by the trial Court refusing to amend the written statement.

After perusing the impugned order, it is clear that the application for amendment was moved after commencement of the trial and the only ground assigned is the change in counsel by the defendants. At this stage, when the evidence of the defendants is being led, I do not find any reason to interfere in exercise of writ jurisdiction.

With liberty to the petitioners to challenge the order passed below Exhibit 133 in appeal if the occasion arises, the writ petition is disposed of.
