Learned A.P.P. appearing for the non-applicant/ State makes a statement that in pursuance of Government Resolution dated 20.09.2022, a Committee has been formed to evaluate the proposal about withdrawal of prosecution. It is informed that the applicant's case was not forwarded by the concerned to the said Committee.

There is no dispute that the offence charged falls within the criteria set out under the Government Resolution.

We directed the concerned Police Authority to forward the applicant's case and submit the proposal to the Committee within one week from receipt of order, who shall in turn, take appropriate decision in accordance with law within one week from the receipt of the proposal.
