Heard the learned Counsel for the rival parties.

Perusal of the impugned order it appears that after having framed the charge against the accused persons the case is fixed for examination of prosecution witnesses and the programme in this regard has been fixed.

Shri Chahande, the learned Counsel states that despite fixation of programme the prosecution witnesses have not turned up. Since, it is seen, that the programme of sessions trial was already fixed and as contended by Shri Chahande, the learned Counsel, if the witnesses have not turned up, the trial Court should take steps to complete the sessions trial in accordance with law rather than adjourning it repeatedly. That being so, I am not inclined to entertain

this application for discharge and make the following order :- Order A] Criminal Application (APL) No.273 of 2015 is rejected.

B] The trial Judge is directed to complete the trial within a period of three months from today.
