The petitioner, the original defendant no.1 in Special Civil Suit No.765 of 2014, has sought expeditious disposal of the Special Civil Suit which is informed to be pending on the file of 10th Jt. Civil Judge, Senior Division, Nagpur.

According to him, since the aforesaid suit is pending for more than ten years, it is necessary to direct the suit to be decided expeditiously having regard to the litigation policy. 4.
When confronted, Mr. Mishra, learned counsel for the petitioner has fairly conceded that the petitioner has not moved before the concerned Court with a prayer for expeditious disposal of the suit. 5.
In this backdrop, we deem it appropriate to dispose of the writ petition with permission to the petitioner to move before the concerned Court with a prayer for expeditious disposal of the suit. 6.
Such prayer is expected to be considered and dealt with by the Court of 10th Jt. Civil Judge, Senior Division, Nagpur before whom Special Civil Suit No.765 of 2014 is pending in which the petitioner is shown to be defendant no.1 in accordance with law and having regard to the litigation policy viz. pendency of suit for more than ten years. 7.
With these directions, the writ petition stands disposed of. No costs.
