IN THE HIGH COURT OF JUDICATURE AT BOMBAY
NAGPUR BENCH, NAGPUR Second Appeal No.347 of 2014 (Yadao s/o Karu Kadao and others v. Tarabai w/o Govinda Kadao and others) Office Notes, Memoranda of Coram, appearances, Court's orders or directions Court's or Judge's orders and Registrar's order Smt. Vijaya Thakre, Advocate for Appellants.
None for Respondents.
Coram : R.K. Deshpande, J.
Date : 6 th June, 2016 Both the Courts are concurrent in holding that the suit property is the ancestral property of the plaintiffs and the defendants. The property stood in the name of Karu Kadao, who had two sons - Yadao and Govinda. Karu died intestate. In view of this, Yadao and Govinda both succeed to the estate of Karu Kadao. Even if it is accepted that the property was self-acquired property of Karu Kadao, being the wife of Govinda, one of the sons of Karu Kadao, the plaintiffs were entitled to maintain the suit.
Thus, no substantial question of law is involved in this second appeal. The second appeal is dismissed. Judge.
