Learned counsel for the petitioner has drawn attention of this Court to the judgment of the Division Bench in the case of Jagdish Pitamber Pawar v. Pitamber Pundalik Pawar and others [Writ Petition No.36 of 2023] wherein it is held that a person other than the senior citizen preferred an appeal under Section 16 of the Maintenance and Welfare of Parents and Senior Citizen Act, 2007. He submits that he be permitted to withdraw the petition and that the appellate authority be directed to entertain the appeal filed by the petitioner. He further prays for continuation of interim relief for a period of two weeks.

Learned counsel for respondent nos.4 and 5 records no objection if such arrangement is made. 3.

In view of above, the petition stands disposed of.

wp2199.20.O.odt The petitioner to file appeal before the Competent Authority under the provisions of the Maintenance and Welfare of Parents and Senior Citizen Act, 2007 within a period of two weeks. If the appeal is filed within this period the issue of limitation shall neither be raised nor entertained by the appellate authority.
