Heard Mr. S.K.Bhoyar, the learned advocate for the petitioner and Mr. K.L.Dharmadhikari, the learned A.G.P. for the respondent Nos. 1 to 3.
This application is filed by the respondent No.4 praying that the interim order granted by this Court be vacated.
With the assistance of the learned advocates for the respective parties, I have examined the documents placed on record of the writ petition.
I find that the respondent No.4 has not made out any case for vacating the interim order which is passed by this Court after hearing the learned advocate for the petitioner and the learned A.G.P. Furthermore, this court had directed the petitioner to serve the respondent No.4 privately and accordingly the petitioner filed submissions dated 25th August, 2013 pointing out that the respondent No.4 had refused to accept the private notice and also the notice sent
2 caw1486.14 by Registered Post Acknowledgment Due. The respondent No.4 has not explained as to why she could not appear on 10th September, 2013 when the interim order came to be passed.
I see no reason to vacate the interim order. The Civil Application is dismissed.
C.A.W.NO. 2077/2013 The filing of the true translation is dispensed with on the condition that the petitioner shall file the true translation as and when required by this Court. The Civil Application is disposed of accordingly. JUDGE RRaut..
