DATE : 20.04.2017 By this civil application, the applicant seeks a direction against the respondents to supply the original marksheet of the 8th Semester and the other relevant documents, i.e., provisional degree, college leaving certificate, etc. to the petitioner, subject to the decision of the petition. Shri Meghe, the learned Counsel for the respondent no.2 - College states that the College has received the fees that are liable to be paid by the regular students in respect of the petitioner from the State Government. It is stated that if this Court so directs, the original mark-sheet, college leaving certificate and the provisional degree would be supplied to the petitioner provisionally and subject to the result of the petition.

2004caw868.17.odt In the aforesaid set of facts, we direct the respondent nos.2 and 4 to supply the original mark-sheet of the 8th Semester and release all the necessary documents in favour of the petitioner provisionally, subject to the petitioner furnishing an undertaking in this Court and to the respondent no.2 within one week that in case the petition ultimately fails, the petitioner would pay the fees that are liable to be paid by the regular students to the State Government, as the State Government has paid the fees for the petitioner to the respondent no.2- College. The civil application is allowed in the aforesaid terms and disposed of.
