The present application is filed for condonation of delay in filing Second Appeal. There is a delay of 164 days, calculated by the appellant. The learned Counsel for appellant submits that, in view of the judgment of the Hon'ble Supreme Court in Suo Motu Writ Petition, the delay is only of 50 days.

For the reason stated in the application in paragraph No.2, I am satisfied that there is no deliberate or intentional delay. Accordingly, the delay in filing Second Appeal is hereby condoned.

The Registry is directed to register the Second Appeal.

The application is disposed of accordingly.
