Scheduled Tribe Certificate Scrutiny Committee, through its Member Secretary, Amravati and another.
--------------------------------------------------------------------------------------------------------- Shri A. J. Dhoble, Advocate h/f Shri R.S.Parsodkar, Advocate for petitioner. Ms Tajwar Khan, Assistant Government Pleader for the respondents. --------------------------------------------------------------------------------------------------------- CORAM :- NITIN W. SAMBRE AND ABHAY J. MANTRI, JJ.
DATE :- 22nd MARCH, 2024.
P. C.
The order dated 20.02.2014 passed by the respondent no.1Committee, in our opinion, is not sustainable particularly when the Committee has discarded all the documentary evidence on the ground that the area from where the documents are generated pertain to Halbi sub-caste of Koshti people, who happened to be the relatives of the petitioner. 2.
Once the States Reorganisation Act, 1956 came into force and the area in restrictions were removed, such finding of the Committee cannot be said to be sustainable.
3.
That being so, the order impugned dated 20.02.2014 passed by the respondent no.1-Committee is quashed and set aside. The petitioner is
1-WP-2003-2014.odt 2/2 permitted to appear before the respondent no.1-Committee on 22.04.2024. The respondent no.1-Committee is directed to decide the claim of the petitioner within a period of six months thereafter. 4.
Rule stands disposed of in aforesaid terms. No costs. Pending civil application also stands disposed of. (ABHAY J. MANTRI, J.) (NITIN W. SAMBRE, J.) Andurkar..
