It is seen from the F.I.R. as well as the reply filed by the prosecution that the present crime for the offences punishable under Sections 65, 82 and 83 of the Maharashtra Prohibition Act has been registered against the present applicant only because the driver of the vehicle in question made a statement that he together with the present applicant were transporting the illicit liquor on the say of the owner of the vehicle, Nirmal Dhamgaye. There is no evidence, it appears, available on record, showing any concrete role having been played by the present applicant in the alleged crime. Therefore, in my view, this is a fit case for grant of anticipatory bail.
The application is allowed. Interim anticipatory bail granted to the applicant on 13/4/2016 is hereby confirmed on the same terms and conditions and also additionally on the conditions that the applicant shall cooperate with the police during the course of investigation, shall not tamper with the prosecution witnesses and shall attend the Court regularly on the dates fixed in the case.
