"By consent, list the matter on 23/1/2024 under the caption of 'Settlement' as a last chance. If the dispute is not settled before the next date, the parties shall proceed to argue the matter."

It appears that the matter has been either settled or the parties are not interested in prosecuting the appeal. 3] The appeal is, therefore, dismissed under Order XLI Rule 17 read with Order XLII Rule 1 of the Code of Civil Procedure, 1908 with costs of Rs.5,000/- to be paid to the High Court Bar Association Library, Nagpur. Restoration application, if any, shall be listed only upon depositing costs.
