The only prayer made by the petitioner is for a direction to the respondent nos.1 and 2 to recover an amount of Rs.1,74,284/- with interest, from the respondent no.3 with effect from 30.08.2011 till the date of actual realization, in terms of the order passed by the Controlling Authority under the Payment of Gratuity Act, on 05.12.2012.

Shri Ambarish Joshi, the learned Assistant Government Pleader appearing on behalf of the respondent nos.1 and 2, states on instructions that the recovery proceedings are pending before the Tahsildar, Teosa and the notice of demand has been served on the concerned respondent. It is stated that the order would be executed within a period of six months.

By accepting the statement made on behalf of the respondent nos.1 and 2 by the learned Assistant Government Pleader, that would be binding on the respondent nos.1 and 2, we dispose of the writ petition with no order as to costs. JUDGE JUDGE APTE
