This application is preferred seeking temporary bail on medical ground.

The applicant is accused of commission of offences punishable under sections 20 and 29 of Narcotic Drugs and Psychotropic Substances Act, 1985 and his application for bail is rejected by this Court on merits.

Perusal of paragraph 3 of the application shows that the applicant is complaining of pain in chest and high blood pressure. It is stated that the applicant is availing continuous medical treatment in jail from 25.1.2021 till date. The applicant admits that he was referred to the Akola and Nagpur Government Hospitals for better treatment. However,
the applicant contends that he has not recovered. While a statement is made that the doctor has suggested several tests and surgery, no details are disclosed. I have not came across any material to suggest that any doctor has recommended surgery.

The medical papers which are placed on record alongwith the application do not disclose illness of such nature or gravity as would not be treated at the Government Hospitals.

The learned APP Mr. N.R. Rode has placed on record the latest medical papers. The doctors at Government Medical College and Hospital, Nagpur have conducted all possible tests. The chest is clear and the heart sounds normal. While there appears to be a simple renal cortical, the renal artery doppler test is within the normal limits, the creatinine percentage is within the normal range and so is the urea. The angiography conducted has not shown any abnormality. 6.
In this view of the matter, no case is made out for grant of bail on medical grounds. However, the Jail Authority
is directed to constantly monitor the health condition of the prisoner and to ensure that all possible medical assistance is provided, if need be, after referring him to the Medical College, Nagpur.
