CORAM
: S.B. SHUKRE, J.
DATE : 19 th APRIL, 2018.
Heard.
Perused the reply of the prosecution and copy of the charge-sheet. The allegation made against this applicant is that on the pretext of false promises given for securing the jobs, this applicant cheated the complainant and his friends of the amount of Rs.11,62,500/-. Now, the investigation is over and the charge-sheet has been filed on 12/01/2018. The applicant is in jail since 21/11/2017. I do not think that now any purpose would be served by keeping the applicant behind the bar. Besides, the applicant has roots in the society and there does not appear to be reasonable possibility of the applicant making himself unavailable for the trial. As regards the possibility of the applicant in indulging in similar
ba.335.18 2/2 crime by virtue of the previous pending crimes against him, I find that stringent conditions can be imposed to take care of such an apprehension of the prosecution.
The application is allowed. It is directed that the applicant be released on bail on his furnishing a P.R. Bond of Rs.50,000/- together with one solvent surety in the like sum on the following conditions :
i.
The applicant shall report to the concerned police station every Sunday between 11:00 a.m. and 12:00 p.m. till conclusion of the trial.
ii.
The applicant shall co-operate with the trial Court in expeditious disposal of the case.
iii.
The applicant shall not tamper with the prosecution witnesses in any manner.
The application is disposed of as such.
