Date : 20 th March, 2017 The learned counsel for the applicant/appellant has tendered an application for withdrawal of second appeal and refund of court-fees in accordance with law. It is stated in the application that the parties have amicably settled the dispute and, therefore, the appellant does not want to prosecute the present appeal.

Hence, the application for condonation of delay is permitted to be withdrawn.

Consequently, the second appeal does not survive. The office shall pass an order about refund of court-fees, if permissible, in accordance with law.
