Date : 22 nd September, 2017 An order of recovery of an amount of Rs.63,411/- was passed against the petitioner on account of reduction in the construction material. This was the subject-matter of challenge before the Maharashtra Administrative Tribunal, Nagpur Bench, Nagpur, which has dismissed the Original Application. The original applicant is, therefore, before this Court in this writ petition.

It is not disputed before us that the petitioner expressed in writing on 29-12-2016 that he was prepared to deposit the amount of recovery of Rs.63,411/- and to take the voluntary retirement from service. Accordingly, the petitioner had paid the

2909wp2229.02.odt amount and he was permitted to voluntarily retire from service. His post retiral benefits were also released. The petition has, therefore, become infructuous. The same is dismissed as such. Rule stands discharged. No costs. (Manish Pitale, J.) (R.K. Deshpande, J.) Lanjewar
