DATED : APRIL 5, 2019 The petitioners are working on the posts of Auxiliary Nurse Midwife in the Public Health Centres run by Zilla Parishad, Nagpur. They are claiming regularization in the posts which they are holding since 2007 or 2008. They apprehend termination of their services because of the advertisement issued by Zilla Parishad inviting applications for filling up about 238 posts of Auxiliary Nurse Midwife.

The Industrial law provides better protection to such employees and if available under Industrial law, it can be claimed by filing appropriate complaints in the Industrial Court. Thus, the petitioners have an alternate remedy, which can be availed. The petition is, therefore, dismissed with liberty to petitioners to approach the Industrial Court.

All questions are kept open.
