CORAM : V.M. DESHPANDE AND AMIT B. BORKAR, JJ. DATED : JULY 14, 2021 This is an application for grant of parole. The State has filed its reply. In paragraph 8 of the reply, it is stated as under:

"8.

It is further submitted that the present petitioner has completed his respective sentences on 05.07.2021. That the petitioner is confined in present condition as a under trial prisoner in Crime No.259/2014, as per order of Special District and Sessions Judge, Gwalior, Madhya Pradesh.

Presently there is no any criminal case has been pending against petitioner in Maharashtra State, therefore, he will be transferred to Gwalior Central Prison (M.P.) for his pending case finalization when availability of police escort."

In view of the aforesaid submission on affidavit, which is not disputed by Ms Wankhede, we dispose of this writ

crwp431.21.odt petition with permission to the petitioner to file appropriate application for grant of bail before the appropriate Court in the State of Madhya Pradesh.

In the meanwhile, it will be open for jail authority to transfer the petitioner to Gwalior Central Prison, if escort is available.

The application is disposed of.
