DATED : 20 JUNE, 2016 APPP NO. 561/2016:
Heard.
The application is granted in terms of its prayer clause.
ABA NO.234/2016 :
Heard learned Counsel for the applicant and learned A.P.P. for the State, who has been assisted by Shri Nawab, learned Counsel for the victim. Although, the learned Counsel for the applicant submitted that the applicant has been regularly attending the police station as directed by this Court and has been cooperating in the investigation, on perusal of the case diary, it appears to me that this is not a fit case wherein this Court should exercise its discretion for granting anticipatory bail to the applicant. There are statements of witnesses, which prima facie make out a case as alleged against the applicant and it appears that his custodial interrogation may also be necessary. Therefore, I am not inclined to grant this application.
The application stands rejected.
