Heard learned counsel for the rival parties.

Perused the impugned order made by the Sessions Judge. Perused the statements shown to me from the case diary.

It is not in dispute that the applicant is not involved in any overt act in respect of the commission of offence of gang rape and appears to be at the scene subsequently. It appears that similar is the case of other accused persons, who have been released on bail. The fact remains that the three accused who committed the overt act have not been released on bail and are in jail. That being so, looking to the role played by the present applicant, following order is passed.

ORDER

(i) Criminal Application No.282/2015 is allowed.

(ii) The applicant-Siraj Khan @ Raja s/o Shahajdkhan Pathan be released on bail on his executing PR bond in the sum of Rs.10,000/- with one surety in the like amount.

(iii) The applicant as well as other applicants, who have been released on bail, shall not enter Chandrapur City till the trial is over, except on the dates of appearance before the Court.

(iv) The trial Judge shall extend witness protection to the complainant.

(v) The trial Judge shall expedite the trial and shall complete the same within a period of six months from the date of receipt of this order.
