I do not intend to deal with the rival contentions since the learned Counsel for the respondent-plaintiff Mr. N.B. Rathod states that the suit seeks injunction simplicitor and the plaintiff intends to withdraw the suit and institute a comprehensive suit.

In this view of the matter, the petition is disposed of since nothing survives in the petition.

The rival contentions are kept open.
