Heard learned counsel for the parties.
Admittedly, there is no order of issuing process made on the private complaint case. The present application under Section 482 of the Cr.P.C. has been filed to quash private complaint filed before the trial court, which was registered as S.C.C.No. 1450/2013.
Mr. Ambilwade, learned counsel for the applicant has pointed out a notice dated 17.12.2012 of compounding the case, issued by complainant under he provisions of Section 48 of the the Legal Metrology Act, 2009. Mr. Ambilwade, therefore, submits that the said letter has given a cause of action to him.
Learned A.P.P. is unable to make a statement as to whether the process has been issued or not.
apl277.14 Be that as it may. Insofar as the present application is concerned, nowhere it discloses the order issuing process. I, therefore, find that the present application is sans any cause of action. That being so, I make the following order.
ORDER
(i) Criminal Application (APL) No.277/2014 is rejected reserving liberty in favour of the applicant to take such steps as are available in law.
