The only prayer made by the petitioner in this writ petition is for a direction to the respondent-Scrutiny Committee to decide the caste claim of the petitioner within a time frame. The petitioner has sought the protection of his education till his caste claim is decided.
Shri Tembhare, the learned Assistant Government Pleader appearing on behalf of the respondent-Scrutiny Committee, states on instructions that the caste claim of the petitioner is pending before the Scrutiny Committee and the same would be decided as early as possible.
Since the caste claim of the petitioner is pending before the Scrutiny Committee for verification, despite the fact that the respondent-College is not served with the notice of final disposal, we allow the writ petition and direct the Scrutiny Committee to decide the claim of the petitioner within a period of one year from the date of his appearance before the Scrutiny Committee. The petitioner undertakes to appear before the Scrutiny Committee on 26/05/2016 so that the
2/2 wp2263.16 issuance of notice to the petitioner could be dispensed with. Since the petitioner was not at fault in not producing the caste validity certificate, the respondent-College is directed to protect the education of the petitioner till his caste claim is decided. Order accordingly. No costs.
