Harshwardhan Shobhatai Babarao Godghate v. Election Commission Of India, Thr. Its Chief Election Commissioner Of India, New Delhi And ORS.
2025:BHC-NAG:7064-DB 940.WP.3808.2025.odt
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
NAGPUR BENCH, NAGPUR.
WRIT PETITION (WP) NO. 3808 OF 2025 Harshwardhan Shobhatai Babarao Godghate .Vs.
Election Commission of India, Delhi and others _______________________________________________________________________ Office Notes, Office Memoranda of Coram, appearances, Court's orders of directions Court's or Judge's orders.
and Registrar's Orders.
Petitioner-in-person present CORAM :
ANIL S. KILOR AND VRUSHALI V. JOSHI, JJ.
DATED :
JULY 22 , 2025 .
Heard the petitioner-in-person.
2.
The grievance raised by the petitioner, who claims to be a member of Bahujan Samaj Party since last many years, is that at the organizational level the party has not conducted election as per the directions issued from time to time by the Election Commission. The petitioner appears inperson and argues that notices were also issued to the Election Commission, however there is no action.
3.
After going through the notices, it appears that in those notices there was no prayer made as made in the present matter. Those notices were for prayer to suspend the office bearers of the said party.
4.
In the circumstances, we are of the opinion that unless the petitioner approaches to the concerned authority
940.WP.3808.2025.odt and seeks relief as prayed in the present writ petition, the present petition cannot be entertained directly. 5.
Accordingly, the writ petition is disposed of, with liberty to the petitioner to approach to the appropriate authority by moving appropriate application as permissible under the law. Pending applications, if any, also stand disposed of.
