The challenge is to a view taken by the Industrial Court that in view of the decision of the University and College Tribunal, Nagpur dated 09.01.2017 the complaint is rendered infructuous.

2] There is no infirmity with the view taken since after the employee was disengaged he did approach the said Tribunal which held that the disengagement did not amount to retrenchment.

3] Shri Meshram would submit that the petitioner may be permitted to withdraw the petition with liberty to challenge the adjudication by the University and College Tribunal, Nagpur.

4] The petition is disposed of as withdrawn with liberty as prayed.
