ATE : JULY 16 , 2024 The petitioner has superannuated on 31/12/2023 and her entitlement for terminal benefits is not a fact in dispute. 2) It appears that after the order of termination of the petitioner was set aside by the School Tribunal, the writ petition was preferred by the respondent Nos.1 and 2, which was also dismissed on 16/02/2024.
3) The respondent Nos.1 and 2 had a bounden duty to process the pension papers and the papers relating to other entitlements of the petitioner well within time so that by the date she retired/stood superannuated, she would have been given all the benefits.
4) The learned Counsel for respondent Nos.1 and 2 informs that the steps are being taken by the said respondents for releasing the terminal benefits. It is claimed that in any case, within a period of two weeks from today entire papers relating to releasing of terminal benefits in the form of pension
2 905-wp 2507.2024.odt and other entitlements shall be submitted to the Competent Authority.
5) The aforesaid statement is accepted as an undertaking. In case the statement is not honoured for whatsoever reason, the Court will be constrained to initiate Contempt Proceedings against Office bearers of the respondent Nos.1 and 2.
6) As far as respondent No.3 is concerned, we deem it appropriate to direct the respondent No.3 to process the said papers forthwith and ensure that the pension and other benefits are released in favour of the petitioner within a period of eight weeks from the receipt of the said papers.
7) Accordingly, petition stands disposed of in the aforesaid terms.
