The petitioner has been convicted for the offence punishable under Section 376 of the Indian Penal Code along with the provisions of the Protection of Children From Sexual Offences Act, 2012. On account of death of petitioner's wife, he has applied for death parole. Initially, the Authority has granted death parole for seven days with police escort on condition of paying necessary charges.

The petitioner urges before this Court that considering his financial poor condition, he is not in a position to bear the escort charges, and, therefore, he urged to grant death parole of seven days without charges for the purpose of funeral of his wife.

Learned A.P.P. upon instructions, has submitted that having regard to the fact that yet the last rite have not been performed and the dead body has been kept in a mortuary, the Authority has granted two days emergency

2 40.wp.305.24 parole with escort without charges.

It is brought to our notice that the petitioner's wife died at Mumbai. Undisputedly, the dead body is still kept in the mortuary awaiting for last rite. Considering the geographical distance, we direct to extend death parole with police escort without charges for three days. 6.

The petition stands disposed of accordingly.
