IN THE HIGH COURT OF JUDICATURE AT BOMBAY

s Orders.

Shri C.M. Samarth, Advocate for petitioner.

Ms H.N. Jaipurkar, AGP for respondent nos.1 and 2. Shri Rohit Joshi, Advocate for respondent no.3. CORAM : AMIT B. BORKAR, J.

DATE : 30 th JUNE, 2022.

Advocate for the petitioner has filed pursis stating that the petitioner has taken back entire papers from him. Thereafter, he tried to contact telephonically but no response is received from the petitioner.

2.

Pursis is taken on record and marked it as "X" for identification. I have carefully perused the impugned order. On perusal of the impugned order, it appears that the impugned order has been passed under Section 152 of the Maharashtra Cooperative Societies Act against whom the petitioner has remedy by way of revision under Section 154 of said Act. The Full Bench of this Court in Shireen Sami Gadiali and Anr. Vs. Spenta Co-op. Housing Society Ltd. and ors.

1 has held that filing of revision is a matter of right. 3.

In that view of the matter, this petition cannot be entertained. The petition is therefore dismissed by granting liberty to the petitioner to adopt alternative statutory remedy.
