DATE : 02-05-2023 The application for amendment filed by the petitioner/wife has been rejected on the ground that the additional ground for divorce which is now been sought was already available to the petitioner. In my considered opinion, that cannot be a reason for rejecting the application for amendment as it would be appropriate, if the additional ground is decided in the present proceeding itself which would avoid multiplicity of litigation, considering which, in spite of opposition by the learned Counsel for the respondent, impugned order dated 17-03-2023 is hereby quashed and set aside and the application for amendment Exh 49 is allowed. No costs.

The amount of Rs.15,000/- deposited in this Court, be refunded back to the petitioner.
