After hearing the learned Counsel Mr. Rajnish Vyas at length, I clearly expressed my disinclination to grant bail. 2.

At this stage, the learned Counsel submits that instead of passing an elaborate order, the applicant be permitted to withdraw the application, with liberty to apply for bail afresh in the eventuality that there is no effective hearing in the trial Court in the next six months.

The application is dismissed as withdrawn, with liberty as prayed.

It is expected that the learned trial Judge shall frame charge, and if necessary separate the trials of the absconding accused, and then proceed with the matter, as expeditiously as possible.

It is made clear that the liberty shall be available only if the delay is not attributable to the accused. 6.
