After hearing the learned Counsel for the applicant to some extent and after going through the depositions which are recorded before the Court which shows that the present applicant is identified before the Court which is a substantial evidence regarding the presence of the present applicant. Considering the fact that now the trial is already at the fag end, I have shown my disinclination to grant bail. Hence, the learned Counsel for the applicant seeks permission to withdraw the appeal.

The appeal is disposed of as withdrawn.

The trial Court shall not be influenced by the observations made by this Court.
