This application has been moved by the respondent in Writ Petition No. 1446 of 2015 praying that the action be initiated against the partners of the original petitioner-firm on the ground that the true copy of the reply dated 09.04.2014 had not been placed on record before the trial Court as well as before this Court. Reference is made to the actual reply submitted on behalf of the petitioner which is at page 220 of the record. Reply has been filed on behalf of the petitioner in which unconditional apology has been tendered. It has been stated that the civil suit filed by the petitioner firm has been withdrawn and the period of black listing has also come to an end.

Having perused the application and the reply filed thereto, in the facts of the present case by accepting the unconditional apology tendered by the petitioner, the application stands disposed of. JUDGE svk
