The applicant is in judicial custody 05.03.2018 in connection with Crime 635/2017 for offence punishable under sections 409, 420, 436, 471, 120-B, 201 read with section 34 of the Indian Penal Code.

The charge-sheet is filed on 30.05.2018.

In view of the special circumstances of the case, this court does not consider it appropriate to consider the submissions of the learned counsel for the applicant on merits.

The applicant is detected as HIV-1 positive. The wife of the applicant is also suffering from the said dreaded disease. The applicant is physically challenged with 60% disability.

In view of the ailment and the disability, I do not consider it appropriate to continue the custody of the applicant. The application is allowed.

The applicant be released on furnishing personal

ba351.18.O.odt 2 bond of Rs.15,000/- with a solvent surety of the like amount.

The applicant shall not tamper with the evidence nor shall applicant directly or indirectly attempt to influence the witnesses in any manner.
