Heard Shri Jaiswal, learned counsel for the petitioner, Shri Pathan, learned AGP for respondent Nos. 1, 3 & 4 Shri Mirza, learned counsel for respondent No. 2 and Shri Parchure, learned counsel for the intervenors.

The applicants are executors of Will by Dr.

Dadi Balsara, who happened to be devotee of Hazarat Baba Tajuddin. The executors point out that Dr. Balsara bequeathed a sum of Rs. Five crore to the said Trust. They seek leave to deposit that amount with the registry of this Court with a direction to invest it properly so that as and when the dispute is settled and amount becomes available for its utilization, with accrued interest, it can be put to use.

The learned counsel for the respective contesting respondents and other intervenors have no objection.

Accordingly, Civil Application is allowed. The Executors/ applicants be joined as respondent Nos.

2704caw879.15 5, 6 & 7 in the petition. The necessary amendment be carried out within two weeks.

The executors to deposit the amount of Rs.

Five crore with the registry of this Court within a period of four weeks. After deposit, the amount shall be invested in any Nationalized Bank initially for a period of three years.

The learned AGP for Respondent Nos. 1, 3 & 4 is seeking time till after vacation to file reply to the petition.

Time granted. List the matter for further consideration on 23.06.2015.
