ORAL JUDGMENT : (PER SUNIL B. SHUKRE, J.) Hearing was conducted through video conferencing and the learned counsel agreed that the audio and video quality was proper.

Heard Shri Pravin Patil, learned counsel for the petitioner and Shri N.R.Patil, learned AGP, who waives notice on behalf of respondent no.1. There is no need to issue notice to respondent no.2, as no relief in this petition has been directly sought against respondent no.2.

The only relief sought in this petition is issuance of direction to respondent no.1 for taking decision as regards the pending proposal sent by the petitioner seeking approval of respondent no.1 for putting respondent no.2 under suspension during denovo trial. Hence, Rule. Rule. Rule made returnable forthwith. Heard by consent of learned counsel appearing for the parties.

Considering the nature of the prayer made in this petition, the petition is partly allowed.

Respondent no.1 is directed to take appropriate decision on the proposal for suspension of respondent no.2, in accordance with law, within 15 days from the date of the order. 6.
