Hearing was conducted through video conferencing and the learned counsel agreed that the audio and visual quality was proper.
2] The applicant is apprehending arrest in Crime 341/2020 registered at Police Station Dharni for offence punishable under section 376(2)(n) of the Indian Penal Code. According to the informant the applicant developed physical relationship promising marriage and then refused to marry her. It was on 11.06.2020, that the prosecutrix learnt that the applicant married one girl from Hingoli and then decided to lodge the report. Considering the material on record, the contention of the learned counsel for the applicant that the report is lodged due to consensual physical relationship having gone sour, cannot be brushed aside. The applicant was protected by this Court vide order
2 ld-vc-cri aba 684.20.O.odt dated 19.07.2020. The applicant has attended the Police Station and it is not the case of the learned APP that he has not co-operated. No custodial interrogation is necessary. 3] The application is allowed and the interim protection granted vide order dated 10.07.2020 is made absolute on the same conditions.
