Shri Shakil V. Deshmukh, learned Advocate for the petitioner seeks permission to withdraw the petition with liberty to file appropriate application seeking same relief which was rejected by the learned Lower Appellate Court by way of impugned order.

The petition is dismissed as withdrawn with liberty as prayed for.

It is clarified that if such an application is filed by the petitioner, same shall be decided on its own merits without influenced by the pendency of the appeal before the learned Lower Appellate Court.
