Heard the learned counsel for the rival parties.

Perused the statement of the witness. Upon perusal of the statement of witness, it appears that the witness had identified the applicant during the course of identification parade. He is a witness on last seen at 09.00 p.m.

earlier night whilst the dead body was found at about 9.30 a.m. in the morning.

That, being so and looking to the delicate nature of evidence, I am not inclined to grant the application.

Hence, the following order :

Order A] Criminal Application (BA) No.288 of 2015 is rejected.

B] Trial Court is directed to expedite the trial.
