This is an application preferred by the husband praying for transfer of proceedings initiated by the wife under Section 125 of the Code of Criminal Procedure so also under the Protection of Women from Domestic Violence Act, 2005. Both these proceedings are pending before the learned Judicial Magistrate First Class, Sironcha.

In the aforesaid background, earlier proceedings under Section 408 of the Code of Criminal Procedure was filed by the husband before the Sessions Judge, Gadchiroli which came to be rejected and therefore, the present proceeding.

During the pendency of the proceedings, the joint pursis is tendered under the signature of the learned counsel for applicant and learned counsel for nonapplicant, which is marked for the identification as document 'X' and is taken on record.

By way of joint pursis, both the parties have agreed that the aforesaid two proceedings under Section 125 of the Code of Criminal Procedure and Protection of Women from Domestic Violence Act, be transferred from the Court of Sironcha to the Court of Gadchiroli. 6.

In view thereof, I pass the following the order : (i) Criminal Miscellaneous Application No.101/2022 initiated under Section 125 of the Code of Criminal Procedure and PWDVA Appln.

No.01/2022 pending before the Court of Judicial Magistrate First Class, Sironcha be transferred to the Court of the learned Judicial Magistrate First Class, Gadchiroli.

(ii) The parties to appear before the Court at Judicial Magistrate First Class, Gadchiroli on 01.10.2025.

The criminal application is disposed of accordingly.
