Mr. Deo, learned ASGI for the respondents, states the petitioner was found medically unfit. It is further submitted that the respondent-CRPF intimated the petitioner to make a request for appointment of some other person from his family on compassionate basis. But there is no request from the petitioner's family. The petitioner was found to be handicapped and on more than two occasions, he was medically examined and that is the reason why we think that no fault could be found out with the respondent, which para-military force, in not appointing the petitioner, though on compassionate basis.
wp3838.14 However, we hope and trust that the respondents, upon receipt of such a communication intimating the name of some other family member from the petitioner for being appointed on compassionate basis, would take a compassionate and sympathetic view.
Mr. Dharmadhikari, learned counsel for the petitioner, states that he would advise his client accordingly and take necessary steps as early as possible. Writ Petition No.3838/2014 is, therefore, disposed of. No order as to costs.
