DATED : APRIL 3, 2019 The prayer clause (1) in the civil application runs as under :
"issue a direction to the respondent no.15, i.e. the Election Commissioner to ensure that the necessary facilities are provided at every polling booth at the time of elections dated 11/4/2019."
There cannot be any dispute and in fact it is not disputed by any of the respondents that necessary facilities are required to be provided at every polling booth at the time of elections to be conducted on
0304cao724.19 2/2 11/4/2019. The respondents before us give an undertaking that all such facilities shall be provided on the date of elections as are claimed in the prayer clause reproduced above.
So far as other reliefs claimed in the civil application are concerned, if such facilities are not found to exist on the date of elections, applicants can move petition for contempt so that suitable action can be taken against the concerned Officers committing any such lapse.
The civil application stands disposed of.
