The petitioner who is a retired employee of the resondentReserve Bank of India seeks allotment of staff quarter as well as lawn at the Amravati Road Staff Complex since the petitioner intends to hold a family function therein. He has allotted the Community Hall by communication dated 05.04.2023.

It is submitted by Shri R.M.Bhangde, learned counsel for the respondent-Bank that as per the policy of the respondent-Bank the Community Hall/main lawn at the residential quarters can be provided for holding family functions. Accordingly, the Community Hall has been made available for use to the petitioner. He however submits that insofar as garden is concerned, the same is not permitted to be allotted for use of such functions as per the Bank's policy. Similarly, staff quarters can be allotted only to serving employees and not the retired employees.

We find that since the petitioner has been allotted Community Hall for conducting the family function on 15th and 16th April, 2023, it would be open for the petitioner to enjoy the same in accordance with

963-WP-2339-23.odt 2 the terms in the communication dated 5th April, 2023. Besides the aforesaid, the direction to provide the garden and the staff quarter cannot be issued to the respondent since its policy in that regard does not permit the same.

In the light of the aforesaid, the writ petition is disposed of. No costs.
